Booking Conditions for the Cortijo de Rio Madera

1. All offers and bookings subject to availability.

2. The party leader must be18 at time of booking and authorised to book by all other members of the party. He/she is responsible for the booking, payments and all matters relating to the rental.

3. A booking reservation can be made by telephone or email. The Company will hold such reservation for 1 week, by which time it must receive the amount due for the rental - BOOKING FORM.

4. We offer flexible start/finish dates to make it easier to book flights and arrange your stay at the property. However, this will depend on availability.

5. A deposit of 30% of the total rental is payable immediately upon booking. This should be paid by bank transfer directly to the Company's bank account. The Company will send written confirmation of your booking either by post, fax or by email. This will show the booking details, the total rental, and the balance of the rent to be received by the Company 12 weeks before your arrival date. When you receive your confirmation, details must be checked carefully. If anything is incorrect, please tell the Company immediately.

6. If you book less than 12 weeks before your arrival date, payment of your total rental is due straightaway.

7. All prices include Spanish Value Added Tax (currently 10%).

8. The Company has the right to refuse any booking prior to the issue of its written confirmation - you will be advised in writing and promptly refunded any deposit paid.

9. If any payment due in relation to your booking is not paid by the appropriate date, the Company is entitled to assume that you wish to cancel your booking. In this case, the Company will be entitled to keep all deposits paid or due at that date. A reminder will be sent out before your booking is cancelled.

10. A security deposit will be required at the time of paying the final rental. This is for an amount of Euros 1,500 and will be held as security to cover any damage or loss at the property. Our Estate Manager is happy to check the property before your departure to note any such problems. The deposit, less any deductions for damage or loss, will be returned by bank transfer immediately after your departure.

11. The Company shall not be liable for any changes or cancellations, effect on your holiday, loss or damage suffered by you or for any failure by the Company to perform any of their respective obligations to you which is due to any event(s) or circumstance(s) beyond the control of the Company, such as fire, flood, extreme weather conditions, epidemics, destruction or major damage of the property and all similar situations. In appropriate cases (for example where the booking has to be cancelled before departure due to such an event) the Company will refund all monies paid for your booking. No compensation or expenses, etc of any description (including without limitation the cost of securing an alternative property/ accommodation) will be payable in such circumstances by the Company. A travel or holiday insurance is strongly recommended.

12. The Company shall have no liability for any death or personal injury unless it results from the Company's negligence or that of any employee of the Company (providing they were at the time acting in the course of their employment). You must take all necessary steps to safeguard your personal property. No liability is accepted by the Company in respect of damage to, or loss of, such personal property. A travel or holiday insurance is strongly recommended.

13. If you want to change your booking once your confirmation has been issued we will endeavour to assist but please bear in mind that changes cannot be guaranteed. The party leader must then inform the Company as soon as possible whether you still wish to change your booking. If you advise the Company that you do or the party leader fails to contact the Company as soon as possible, your booking will be treated as having been cancelled by you. So as to keep any period of uncertainty to a minimum, the Company will, whenever possible, communicate with you by telephone and you are required to do the same.

14. If you have to cancel your booking, the party leader must contact the Company as soon as possible. The amounts paid for the rental will be retained by the Company unless it is able to rent the property to another client. In such cases an administration fee may be charged.

Renting Conditions

1. You can arrive at the property at the time agreed with the Estate Manager. We will be as flexible as possible to make fit in with your travel plans. On the day of your departure you may be able to stay at the property later - again by arrangement with the Estate Manager. It may be necessary to vacate the bedrooms for changeover and cleaning.

2. You must not allow more people than confirmed in the booking to occupy the property, unless otherwise agreed in writing with the Company.

3. You and all members of your party agree both to look after the property and leave the property in a similar condition as you found it upon your arrival - allowing for normal usage. You are responsible to the Company for the costs of any breakage or damage in or to the property which are caused by you and/or any members of your party, and the Company can require payment from you to cover any such costs.

4. The Company is entitled at its sole and absolute discretion to refuse access to the property (or to repossess it) if it reasonably believes that any serious damage is likely to be caused, has been caused or is being caused by you or any members of your party to its property. Such circumstances will be treated as a cancellation by you and the Company will have no further liability to you as a result of this situation arising. The Company will also not be obliged to find any alternative accommodation for you.

5. Dogs may be taken to the property at the discretion of the Company. Enquiries should be made at the time of booking.

6. Although the pool is in itself safe for younger children and indeed for elderly people, with large, comfortable steps leading down to the deepest level, adult supervision is necessary at all times as for any swimming pool to prevent any accidents. There is an electrically operated cover for complete security.

7. You must allow the Company or any of its workmen access to the property at any time during your occupation of the property for any urgent or emergency repairs, etc. Notice will be given when possible.

8. Every effort has been made to ensure that you have an enjoyable and memorable holiday. If, however, you have any cause for complaint it is essential to contact the Estate Manager immediately so that we can remedy the problem whilst you are in residence at the property. In particular, complaints of a transient nature (for example, regarding preparation of the property upon arrival or heating of the property) cannot possibly be investigated unless registered whilst you. If, after this, you feel that the problem has not been resolved to your satisfaction, then the party leader must, contact the Company representative in London immediately. If you fail to do so, this may affect your entitlement to claim compensation where this may have been appropriate.
